Scope

These Terms and Conditions are applicable to all reservations made with Upper Residences Ltd. (“Upper Residences”) by guests, whether through our website, phone, Online Travel Agents (“OTAs”), or other channels. This Agreement constitutes a legally binding contract between you and us, governing your use of our Service and accommodation units. Violation of this Agreement may result in civil or criminal penalties.

Our Service

Upper Residences acts as an agent providing accommodations and related services at physical properties managed, licensed, leased, or developed by us, partners, or clients. Your use of the Service is for short-term rentals for non-commercial purposes only and is subject to the terms outlined herein.

Reservations

Upon availability confirmation and your compliance with this Agreement, Upper Residences grants you a limited, non-transferable license to occupy a specified accommodation unit for a reserved period and occupancy limit.

Upper Residences reserves the right to modify accommodation offers and may refuse to conclude a license agreement at its discretion.

Important Note: The guest agrees not to make the provided accommodation their primary residency.

Fees and Payment

Certain features may require one-time or recurring fees, non-refundable unless explicitly stated otherwise in writing. We retain the right to determine pricing for services and accommodations, subject to changes and promotional offers.

Payment disputes must be reported in writing within specified timeframes. Refunds may take up to 7 days to process.

Extensions

Modifications to reservations incur charges based on current rates for the modified dates, subject to your acceptance of additional fees.

Cancellation Policy

Cancellation follows stated conditions, beyond which Upper Residences retains the right to the agreed remuneration. No shows, late arrivals, and early departures are non-refundable.

Deposit

Deposit terms are notified at booking. A complete refund is subject to compliance with this agreement.

Other Charges

Utility charges are typically included unless specified otherwise.

Eligibility

You must be at least 18 years old to use the Service, ensuring compliance with laws and regulations.

Check-in Information

Access is granted after full payment and completion of our online check-in form. Check-in time is from 15:00 unless otherwise stated.

Check-out Information

Check-out time is by 11:00 unless agreed otherwise. Late check-out needs prior confirmation.

Provided for Your Stay

Essentials are provided and cleaning is done before and after your stay. Mid-stay services are available upon request and may incur additional charges.

Prohibited Conduct

Guests must comply with regulations and avoid prohibited activities as listed in the Agreement.

Damage to Property and Theft

Guests are liable for damages beyond normal wear and tear, charged accordingly.

Personal Possessions

Upper Residences is not liable for lost possessions. Unclaimed items are held for a limited period.

Maintenance

Efforts are made to perform maintenance without guests, but access might be necessary during your stay.

Luggage Storage

No luggage storage is provided, but options are available through third-party services.

Termination

Violations result in immediate termination of the license agreement.

Overstay

Fees apply for overstaying past check-out time without prior arrangement.

Legal Fees and Expenses

Guests are responsible for legal expenses incurred in enforcing this Agreement.

Invoices

Invoices may be issued by the Property owner, and if booked through an OTA, invoices can be obtained from them.

Severance

Invalid provisions will be severed, while the remainder of this Agreement remains valid.

Modification of this Agreement

We reserve the right to change this Agreement, and material changes will be communicated promptly.

Limitation of Liability and Indemnity

Guests indemnify Upper Residences from claims arising from their use of the Properties.

Force Majeure

Events beyond our control may exempt us from liability for failure or delay in performance.

Disputes

Efforts to resolve disputes amicably are encouraged, subject to the jurisdiction of UK courts.

Law and Jurisdiction

This agreement is governed by UK laws.

Notices and Service

Notices shall be delivered through specified means.
